GP appointments & Negligence

GP Negligence!

One illness per GP appointment.

GP Appointments & Negligence, Lack of duty of care.

Patients are being told that doctors are too busy to cope with more 20-minute appointments that they have restricted calls for 10 minutes and to only discuss one ailment per consultation.

Critics say it could put people off discussing important health issues.

People who are vulnerable who have ongoing mental health issues or have multiple issues may be reluctant to phone multiple times.

According to some surgeries dealing with more than one health issue can increase the chances of a mistake. (A GP should not make mistakes, although I have proof that they do, with my daughter being prescribed Gaviscon by the GP yet the A&E diagnosed my daughter with Multiple Sclerosis).

My calculation is if the surgery did an eight-hour shift and had 20-minute consultations, would be 24 patients a day multiplied by 5 doctors would be 120 patients a day multiplied by 5 days would be 600 people a week or 2,400 patients per month that they could consult.

Not everyone comes to the surgery every week or every month, so what are doctors doing if they are having problems with time management?

GPs are insisting that patients raise only one problem per appointment because they are so short of time.

According to the Mail Online (January 2017), those with multiple ailments are being banned from booking longer 20-minute consultations – instead of being told to book a standard ten-minute appointment for each condition they want to discuss.

A ten-minute slot would equate to 6 slots per hour multiplied by 8 hours, which equates to 48 patients per day per Doctor. (48 patients per day per 10 min slots  x 5 GP’s = 240 patients per day x 5 days = 1,200 patients per week x 4 weeks = 4.800 patients per month).

Surgeries are increasingly introducing a controversial policy to cope with rising demand. But campaigners described the rules as ‘outrageous’ and warned they would put off patients from discussing potentially important health worries.

Practices across the UK have adopted the ‘one problem per appointment’ policy which claims it is to improve ‘clinical safety. However, there is a real increased risk that mistakes will be made and things missed as the Doctor may be inclined to rush, particularly if other patients are waiting.’ Other Surgeries have gone one step further by banning any long appointments for multiple health issues.

GP surgeries are under pressure from the rising and aging population on top of a recruitment crisis of family doctors. NHS figures published in December 2016 showed that in some parts of the country the number of patients on surgery lists has soared by 30 percent in just three years.

Katherine Murphy, chief executive of the Patients Association, said: ‘It is outrageous that patients are being told there are rules around the health problems that can be discussed.

We hear so frequently from patients who struggle to even get an appointment that I’m confident most would take such an opportunity to ask about a secondary or less-urgent health concern.

‘Our concerns are that patients will not be given the opportunity, or maybe put off, from asking for medical advice because of this rule, which is a very serious patient safety risk.’

Dr. Helen Stokes-Lampard, chairman of the Royal College of GPs, said she was ‘saddened by the move. She added: ‘For a lot of consultations, particularly for people with chronic diseases or any psychological element to it, to be pressured into ten minutes is really unhelpful.’

Note from the Editor.

In Consideration of the above article, the Editor (myself) who has multiple health issues wrote a nine-page letter to the GP back in May of this year. I sent it via email with an attachment marked as private and confidential. I received an email back from the practice manager who said that she had read the letter (Not addressed to her) and that I needed to discuss my concerns by making a phone call to the GP even though it clearly stated in the letter what my concerns were.

(The GP could have phoned the patient (aka me) to discuss the concerns rather than ignore me altogether).

So, six months later seeing I never received a letter from the GP or a phone call, I happened to be chasing up a missing prescription for my daughter and I decided to kill two birds with one stone and asked for the GP to phone me only to be told I would have to phone back the following day to book a consultation. I replied just mark it on the system that I need the doctor to phone me.

By all accounts, the person I was speaking to could not pass on a message as I will explain.

I related that the letter I wrote in May clearly stated my concerns and that it could be marked on the system for the GP to phone me and that I should not be chasing the GP. The receptionist (male) said he would pass the message on so I thought…

Within minutes of the call ending the practice manager phoned demanding that I phone back the following day to book a consultation, she never said what time, but I presume at 8 am when the lines get jammed from people trying to make appointments for a good half hour to an hour, only to be told the slots are gone and to phone back the day after. This has happened previously to me so maybe the system has changed; I do not know, as I hardly ever phone the GP, I prefer everything in writing?

I said that the doctor should phone me and for the practice manager to pass the message on, who replied the doctor is too busy to read letters or correspond to them and that unless I phoned back in the morning to book a consultation the doctor will not be phoning me.

My reply was, I had to drop what I was doing today to speak with the practice manager that did not schedule a call and did not even ask if it was OK to talk. I continued to say I am also busy and that this call was inconvenient to which the practice manager raised her voice and in a stern tone said “Goodbye” and cut me off by ending the call.

If the GP does not phone me tomorrow, I will go out of my way to name and shame the practice and sue them for negligence for my escalation of health issues and emotional distress.

If I work into the early hours of the morning, I am not going to get up especially early to phone the surgery to ask for the GP to phone me when I have spoken with three people in total that could easily put a post-it note, on the GP’s desk to phone me. It is not difficult.

The overall way they treat their patients does not surprise me why people get agitated. If I were an elderly person, I would not be ringing back, this could then cause the persons’ health to deteriorate even more.

I speak on behalf of everyone who has problems speaking to their GP for multiple health issues. If a letter has been received and as per the phone call today which confirmed my ailments have been put on the system, you would think the care of duty by the clinician should have followed it up, but they have not, which in my way of thinking is negligence.

I suffer from depression and anxiety I am an advocate for mental health and have a website specifically for disabilities www.disabledentrepreneur.uk

I am not ashamed to admit it, I do struggle with anxiety and depression most days and some days are easier than others.

I lost my ex-husband and a family friend this year and around May time, which felt I needed some support from my GP hence wrote the letter not only discussing my mental health but other multiple ailments. Had I have had suicidal thoughts you would not be reading this right now because of my GP’s incompetence.

Imagine someone with a similar health issue relying on the GP to get in touch with them, I dread to think how many people have had their symptoms get worse because of the lack of duty of care by the clinician.

I have now spoken to three people in total over my letter including a cluster pharmacist who phoned me to discuss my medication who also told me she had read my letter and I quote “The letter was very thorough which is what GP’s like”, yet no one has followed up on my health issues?

I did write a while ago about doctor / patient confidentiality:

Some people also have anxiety phoning their GP’s:

Big Tech Giants Forced to Open Offices on Russian Soil.

Big Tech Giants Forced to Open Offices on Russian Soil.

Yes, you are reading this right companies, such as Google, Apple, Facebook, Twitter, and Tik Tok to name a few are being forced to open offices on Russian Soil.

A Bill passed by the British Government allows Russia to fine companies if they do not comply with their terms which means that companies that do not delete content banned by the Russian government could have their sites restricted access if they ‘discriminate’ against Russian media.

From what I understand if countries that oppose social media and restrict their residents, cannot expect the rest of the world to not read or view fact-checked content.

Now let me get this right and just for argument sake I build a social media platform and have more than 500,000. users I will be forced to open an office in Russia even though I am a British Citizen and have no intention of ever doing business with Russia.

So this brings me to the next question who owns the internet and what about free speech?

To answer the question of who owns the internet?

No one owns the Internet, and no single person or organization controls the Internet in its entirety. Yet there are organizations that think they have the right to control the internet as a whole. The internet is more of a concept than an actual tangible entity. The Internet relies on a physical infrastructure that connects networks to other networks. Therefore, the internet is owned by everyone that uses it.

What about freedom of free speech?

Under Article 10 of the Human Rights Act 1998, “everyone has the right to freedom of expression” in the UK. But the law states that this freedom “may be subject to formalities, conditions, restrictions or penalties as are prescribed by law and are necessary for a democratic society”.

This includes the right to express your views aloud (for example through public protest and demonstrations) or through:

  • published articles, books or leaflets
  • television or radio broadcasting
  • works of art
  • the internet and social media

I can understand regulations and restrictions not to mention licenses that website owners and social media companies have to abide by, governed by the laws in their own countries.

Should a country decide to restrict content in their region similar to the EU and GDPR then I understand about licenses in order for the content to be viewed in targeted countries. The General Data Protection Regulation 2016/679 is a regulation in EU law on data protection and privacy in the European Union and the European Economic Area. It also addresses the transfer of personal data outside the EU and EEA areas.

Surely though any country that forces a company to abide by their regulations in order for their residents to view your content then that should be down to the discretion of the company if they want their content viewed or not, pending the purchase of a license.? For example, if a country said to me buy a license or we will restrict your content, then it would be up to me to decide if I wanted traffic coming from the targeted country or not and I could restrict it on my end if I so wished or pay the license. The country that enforces the license could also restrict the content if a license was not purchased.

How To Block A Country Using a WordPress Plugin:

https://geotargetingwp.com/blog/how-to-block-countries-in-wordpress-by-ip-address

You can turn a WordPress Site into a Community Social Media Platform Using BuddyPress Plugin.

WordPress is the easiest to use the platform to build your own social network using the free BuddyPress plugin. It is super flexible and integrates beautifully with any kind of WordPress website. You’ll need a self-hosted WordPress.org website to start using BuddyPress.

Physical Office on Foreign Soil.

However, to be forced to physically open an office in a foreign country is beyond ridiculous. However, with the rules of GDPR that came into force on 25th, May 2018 most website owners added cookie banners and privacy policies whilst others blocked people in the EU from visiting their sites. Here is an example of one site that restricts EU users: https://www.wfla.com/

So how is it that Russia has any say in what BIG Tech Giants can and can’t do unless they are sponsoring and investing in them in some way? The move is to stop any company from promoting propaganda about Russia and that is fair enough in itself.

The 13 foreign and mostly US technology companies must now be officially be represented on Russian soil by the end of 2021 or could face possible restrictions or outright bans. If anything the website owner could restrict a country from gaining access and that is what I would do if I were in the Big Tech Company’s shoes?

Roskomnadzor, Russia’s communication regulator enforced demands that even companies that already have Russian offices will need to register online accounts with the regulator to receive user and regulator complaints, according to Reuters. All of the social media companies named, including the messaging app Telegram, have reportedly been fined this year for failing to delete content that Russia considered illegal.

I agree that all social media giants should stop the propaganda and fake news. However, if the news is fact-checked there is no reason for it not to be published. It stands to reason the social media giants should also remove content that is prohibited, such as drugs, pornography, suicide, and terrorism, or any criminal activities, you do not need the likes of Russia to tell you that and it is the responsibility of the website owner to do their due diligence and be responsible to protect its users from ever accessing anything that is deemed illegal. With High-Tech AI Algorithms, it is easy for robots to scan millions of articles daily and flag them for deletion.

This comes as Russian authorities tried to crack down on social media companies in the wake of protests following the arrest of Russian opposition leader Aleksei Navalny. Furthermore, a court in Moscow filed a lawsuit against Telegram, Facebook, Twitter, TikTok, and Google accusing the social media platforms of failing to remove content calling for teenagers to attend unauthorized protests.

Roskomnadzor also announced that it was restricting its citizens’ access to Twitter, accusing the American company of failing to remove thousands of posts relating to drugs, homophobia, pornography & enticement to unauthorized illegal protests.

Apple, which monopolizes the mobile applications market in Russia has been targeted for alleged abuse of its dominant position. Roskomnadzor said company’s that violate the legislation could face advertising, data collection, and money transfer restrictions, or outright bans.

If I were Apple I would not sell my product to Russia. I have clients that only ship to the UK, it is their prerogative at the end of the day although I am sure Welsh produce would be welcomed to the rest of the world.

Apple and Google in September removed an app meant to coordinate protest voting in the Russian elections. The Russian government has previously said that Moscow had no desire to block anyone or anything, but stressed that companies needed to follow Russian law.

Data that is used by Russian residents should be stored on Russian Servers according to Russia who has imposed repeated fines for banned content. Russia is promoting its domestic tech sector over Silicon Valley alternatives, proposing taxes on foreign-owned digital services, tax cuts for domestic IT firms, and requiring smartphones, computers, and other devices bought in Russia to offer users Russian software by default.

Amazon & Visa Price War

Amazon & Visa Price War.

Amazon has announced today they will not be accepting Visa payments from Brits from 19th January 2022.

This comes to light because of Visa’s high fees for processing card transactions.

Amazon has supposedly told its customers today that it will no longer be accepting payments via this method and that all customers need to update their credit card details so that their subscriptions do not become affected.

Amazon has disputed the costs and has stated that the prices should be going down because of “technological advancements,” the online retailer will still accept debit cards, including Visa, and non-Visa credit cards.

An Amazon spokesman said, “The cost of accepting card payments continues to be an obstacle for businesses striving to provide the best prices for customers. These costs should be going down over time with technological advancements, but instead, they continue to stay high or even rise. As a result of Visa’s continued high cost of payments, we regret that Amazon.co.uk will no longer accept UK-issued Visa credit cards as of January 19th, 2022. With the rapidly changing payments landscape around the world, we will continue innovating on behalf of customers to add and promote faster, cheaper, and more inclusive payment options to our stores across the globe.

On the flip side, a Visa spokesperson said, “UK shoppers can use their Visa debit and credit cards at Amazon UK today and throughout the holiday season. We are very disappointed that Amazon is threatening to restrict consumer choice in the future. When consumer choice is limited, nobody wins. We have a long-standing relationship with Amazon, and we continue to work toward a resolution, so our cardholders can use their preferred Visa credit cards at Amazon UK without Amazon-imposed restrictions come January 2022.”

From the Editor.

For the consumer, this will become an inconvenience if they wish to continue to use Amazon and do not have an alternative payment method.

I do have a recommendation, but first would like to say I am not affiliated or get any monetary compensation for my recommendation with this bank or “Mastercard“, however, I have been a customer of “Cashplus” from the time they first started out in 2005.

Not only has this challenger bank become an official bank this year they have also been shortlisted for “The Atffi Banking Awards 2021“, but by far the best part is they are affiliated with “Mastercard” and one can open a bank account without any credit checks online and be guaranteed an account even if you have a poor credit history.

Hopefully, whatever happens, it will work itself out in the end, but Visa is naive to think that consumers will not be looking for alternative credit/debit card providers to counteract the problem facing them. Furthermore, I disagree with their statement that nobody will win this war as the consumer is astute and will not think twice about changing providers.

Starting Your Own Professional Speaking Business? Avoid These Top 5 Common Mistakes

(Photo via Pexels)

About the Author: Katie Conroy is the creator of AdviceMine.com. She particularly enjoys writing about lifestyle topics and created the website to share advice she has learned through experience, education, and research.

The world of professional speaking can be incredibly lucrative. No matter where you are in your career, it can be worthwhile to turn your skills into a formal business. Whether you decide to create a business for just yourself — or for a group of expert speakers — your venture can pay off big time.

Before launching your new company, it is important to do your research, if you’ve been thinking about starting a professional speaking business.

Not streamlining essential processes

Too many new entrepreneurs spend more time on tasks than needed. There is an abundance of apps, online platforms, and software that can help you do almost anything for a fraction of the time it would normally take. From day one, aim to streamline essential processes for maximum efficiency.

By far, one of the best time-saving tools is invoicing and scheduling software. This will give you a clearer picture of your billable hours and availability for gigs and projects so you can better manage your bandwidth. Better still, you can batch-process invoices so you save time and maybe even get paid quicker. And finally, you can track and pay expenses with ease.

Trying to do all business-related tasks with no assistance

Another major mistake that a large percentage of new entrepreneurs make is trying to do everything themselves. Despite the benefit of saving money, trying to tackle duties such as customer service, graphic design, copywriting, event bookings, and IT work is draining. No one has enough hours in the week to run a business solo. Attempting this can lead to burnout, which may ultimately lead to the closure of your company.

Instead, opt to outsource core duties. On almost any budget, you can hire freelancers for the exact tasks you need. Whether you contract for several hours of work per week or full-time services is completely up to you and your needs.

Forgetting to schedule off days

Closely related to trying to handle all business-related tasks yourself is the mistake of forgetting to schedule time off. When you work as your own boss, you don’t have anyone giving you a vacation day/PTO allotment. Driven business owners may overlook this aspect of running their company, and work seven days a week.

For your health — and for the well-being of your organization — plan time to rest and recharge. This is especially important if you will also be booking speaking engagements for yourself in the near future. Earning an outstanding reputation largely depends on your ability to perform. Exhausting yourself will lead you to show up as less than your best, which isn’t beneficial for anyone.

Not marketing your business to the fullest

Don’t be shy in getting your name out there. Whenever you are presented with an opportunity to market your business and/or speaking services, take it. Marketing your business to the fullest is essential for getting your name out there, and for lining up high-paying speaking events. Regularly post on social media to market yourself. If you need some help in this area, you can hire social media management services through online job platforms. Before hiring a candidate, review their experience and feedback for past work.

Avoiding networking opportunities

As a speaker, one of the best places to promote your services is at networking group events. While online marketing is certainly important, networking events will help local business leaders learn more about you. They’ll also get a firsthand look at your presentation style and speaking topics.

Turning your passion and talent for speaking into a business is a wonderful way to make a living. Utilizing the tips above can help you fast-track this goal and book your first engagement even quicker.

Motivating Yourself & In Business

Motivating Yourself & In Business.

Motivation is the strategy to initiate, guide, and maintain goal-oriented behaviors. Motivation is the driving force behind human actions it is about the ways you and your business can encourage yourself and your staff to give their best performance. Motivation is not just about Business it is about empowering and inspiring oneself to do better, which in turn is passed down to your workforce. Motivated staff care about the success of the business and work better. A motivating workplace results in improved quality as the staff takes greater pride in their work and turns out great results.

However in some cases people especially my family and friends have never understood me when it comes to running a business, after all, they have never had a business of their own.

So when I decline meetups and am content with Skyping they do not support me and come up with advice on how it is not healthy for me to be working from the moment I wake to the moment I fall asleep.

I personally do not listen to people giving me advice, as they may have many opinions to make but may not be experts in the topic of discussion. Unless I am speaking with an expert, someone else’s opinion is simply their own. It does not matter what other people think, what you think is the most important.

As the following interview on Elon Musk explains why he is a workaholic just like me. I can relate to so many things he said and it may also be relatable to you.

Sitting around a dining table chatting about life is a waste of time for me personally, time that can be better spent helping my business evolve. People that cannot see my vision and are not supportive of me, have no right to be dining with me. In fact, I conducted a social experiment a while back and wrote about it called “Support & Encouragement“. It was disheartening to see not one person from my close-knit circle did not respond.

So the other day I reached my limit of 5K friends on Facebook and asked people in my close network of friends and family to subscribe and follow me on other social media channels and again strangers I have never met have the decency to follow me but my family and actual friends have not.

People who are not supportive of you may think of themselves as better than you they may feel they are privileged and like to see you struggle and just wait for you to fail or they could be envious of you. Remember when you reach your goals they will then want to know you.

My business is precious to me I have spent long tireless hours and money building it and will not allow anyone to stand in my way. My business is my baby which needs nurturing. My business model is digital marketing, mentorship, and website design for “People in Business” and people who are Disabled Entrepreneurs.

I would never work these hours for a job I did not love. I believe in helping people and if I can become a good teacher hopefully this will inspire other people to do the same.

I am currently also researching “Neuroplasticity” this link is to articles I have previously written and how to rewire the brain to have positive thoughts. A book I highly recommend you read is “Think and Grow Rich” By Napolean Hill.

If you are wondering why I am an advocate for disabilities is because both myself and my daughter have some form of disability. However, this has not stopped me from doing my work or my daughter doing hers, we have learned to manage our disabilities and work around them.

My ultimate goal is to cure myself and then teach people how I did it. I have started my journey and once I recover I will teach people and tell my story.

I am learning about self-hypnosis which I wrote about on my other blog, how this type of therapy is not available on the NHS, hence it has never been offered to me in the 30 years I have been a sufferer of OCD. Not every person can be hypnotized it does not work for everyone. But if you have a strong enough mindset to believe it will happen, then through the power of suggestion, anything is possible.

There is still a certain taboo about disabilities and I have listed Famous People with Disabilities so that you can understand Disabilities and who has them in the world of celebrities. Elon Musk suffers from Aspergers Syndrome.

Some motivational speakers talk about dream boards. I agree to a certain degree you have to visualize what you want and set goals to achieve what you desire. Scripting your thoughts in a journal every day and using the present tense, you are paving your path to your destiny. You also have to believe that whatever you want can be achieved providing you repetitively every day think and talk about or self-hypnotize yourself into manifesting it.

Empowering oneself and others involves identifying, nurturing, and utilizing strengths. Promoting constructive motivational resources in oneself and others can teach us how to acknowledge and repair weaknesses and vulnerabilities.

My chapter has just started and will post more motivational articles in due course.

An example of Guerilla Marketing was something Baroness Michelle Mone did by promoting her ‘Ultimo Bra brand back in the day when she was starting out by having actors dressed up as plastic surgeons protesting that ‘Ultimo’ was putting them out of business. On the day of the event, all her bras got sold out. Hire a plane or drone with the flogo and have your advert flown sky-high.

3. Create an Email Newsletter List

Once you get subscribers to your website offer them a voucher to sign up and then when you have enough people send out a newsletter with all the latest news, reviews, and product launches.

4. Partner with Local Influencers

It is worth partnering up with people who have a large audience of followers as example we have over 10K connections on LinkedIn alone and we have recently had to let our audience know on Facebook we have had our limit and cannot accept any more connections without deleting one or two. Having us on your side is a Brucey Bonus as we can get you in front of target audiences.

5. Invest in Google and Facebook Ads

Consider Facebook, Instagram, Google, and Bing Ads. However please note there is a daily budget you have to set as these types of ads cost per keyword and some keywords are expensive. Plus the fact you will have to pay a monthly management fee depending on the duration of your advertising.

5. Promote Deals on Groupon

Groupon’s promotional platform allows businesses to advertise deals and discounts to consumers. Whilst advertising on Groupon has its advantages it is up to Groupon the make sure they have sufficient people clicking their ads and they take 50% commission for each purchase. This is a great way for smaller, local breweries to boost brand awareness and bring in new customers.

6. Buy Local Radio Ads

This type of advertising can be costly unless you know your local DJ. However, if you have a stunt to promote, they may advertise you for free especially if you allow them to advertise on your banners. If you mention them in your social media posts and get them to notice they may mention you for free in return. Be sure that the radio station you choose to work with has an audience aligned with your target and shop around a bit to be sure you’re getting a good price.

7. Sponsor Local Events

Target Local Events, where there is an event that draws large crowds, sponsor them and they will advertise you. Or set up an event of your own or join the many beer events being held nationwide.

8. Create a Customer Loyalty Club for Your Brewery

Encourage customers to come back to your brewery again and again by offering loyalty cards and developing a customer loyalty program. Offer annual memberships with exclusive offers that they could not get online.

9. Be an Active Member of the Community

Networking with Hospitality, Business and Charities can gain appreciation locally by getting more involved in local causes and activities. Whatever way you can to spread brand awareness try and incite new leads to do so at a little cost to you other than handing out business cards, leaflets, and vouchers. Your brewery can also co-sponsor events and fundraisers in the local community or partner with restaurants and businesses to host events in your own space. You can reach out to local organizations and chambers of commerce to find opportunities to collaborate and pitch in.

10. Affiliate Marketing

Get your customers and digital marketers to work for you. Do incentive vouchers like introducing a friend or signing up to some affiliate platforms where they manage all payments and conversions.

How Much Will Your Brewery’s Marketing and Advertising Cost?

Depending on your Advertising and Marketing Budget there are effective ways to advertise and market your craft brewery. If you are looking to find consumers nationally some bigger-investment options, like television ads, can be costly. So consider social media the better option as most people use social media at least once a day. In fact, 4.71 billion people use social media worldwide, according to platform reports on the current number of active users. 56.8% of the world’s population is active on social media when looking at eligible audiences aged 13+ years, rising to 82% in North America.

Telephone Encryption to Process Payments.

When Companies Do Not Use Telephone Encryption To Process Payments.

It is drummed into our heads to never give out bank details over the phone especially your CVV number (the last three or four digits on the back of the card), yet some companies still are not PCI DSS Compliant and still insist on processing payments without encryption.

Is it secure to provide debit card information over the phone?

Generally speaking – if the merchant has encryption software installed it is safe to give your card details, however giving your details to a person is not, as they can easily screenshot your information or use spy cameras and use it further down the line say a month or two. Most reputable merchants employ a number of technologies that greatly increase the security level when making payments over the phone.

One of them is your credit/debit card number, which as an owner of the card only you should know, and another is a shortcode called CVV – an abbreviation that stands for card verification value.

Printed on the back of your card, the CVV is a 3-4 digit code and its intended goal is to provide additional security when making purchases. The CVV makes sure you are in possession of the card and not someone else as the code shouldn’t be known to anyone other than the card owner.

Despite all security measures you should never forget that fraudsters are always looking for ways to beat them and steal your credit/debit card information and quite possibly even your money! This is why it is important to know how to protect your data by doing a few simple things you can further protect yourself and your earnings.

This is what you need to know and so by paying attention when providing card details, especially on the phone:

  • If using the Internet, make sure the goods or service you want to buy comes from a reputable website. With that being said, always research the company offering the service or product beforehand.
  • Never make your card details shown in public.
  • Never provide your CVV number when asked on the phone or when processing a card payment in person. This is a sure sign of impending fraud! CVV numbers are for online purchases only!
  • When making a payment on the phone, always obtain the phone number from a trusted source and make the call directly.
  • Always check your monthly bank statement thoroughly for charges you do not recognize.

PCI DSS Compliance

The Payment Card Industry Data Security Standard (PCI DSS) is made up of twelve requirements. These requirements cover a wide range of topics, including securing networks, protecting data, access control measures, information security practices, and monitoring and testing. Its overarching aim is that cardholder data be protected by any organization that stores, transmits, or processes this information. Compliance is enforced by regular audits carried out by either a professional Qualified Security Assessor (QSA), Internal Security Assessor (ISA), or through a Self-Assessment Questionnaire (SAQ).

Non-compliance can result in fines, likely to be imposed by the card issuers via the acquiring banks, for any merchant who fails to meet the required standard.

Any organization that takes credit card payments is subject to the rules laid out in the PCI DSS, and they also apply to payments taken over the phone. For those companies taking payments inside a contact center, they must make sure that they:

  • Demonstrate evidence of compliance with over 400 security controls that are applicable to any part of the contact center environment handling card data.
  • Ensure that sensitive authentication data (CVC2/CVV2 security code) is not stored in any format anywhere, including call recordings.
  • Vet new CSRs and conduct appropriate background checks; an expensive and time-consuming process
  • Make sure data cannot be removed from the call center by any means; usually by restricting the use of pens and paper and banning mobile phones from the contact center.

For a company to brush off your concerns that their payment processing methods are secure, they need to provide evidence of this when asked.

ENCRYPTION (or cryptography) makes card data unreadable to people without special information (called a key). Cryptography can be used on stored data and data transmitted over a network. Payment terminals that are part of PCI-listed P2PE solutions provide merchants the best assurance about the quality of the encryption. With a PCI-listed P2PE solution, card data is always entered directly into a PCI-approved payment terminal with something called “secure reading and exchange of data (SRED)” enabled. This approach minimizes the risk to clear-text card data and protects merchants against payment-terminal exploits such as “memory scraping” malware. Any encryption that is not done within a PCI-listed P2PE should be discussed with your vendor.

Consumer rights

Certain consumer rights in the UK mean that all card transactions come with responsibilities for the merchant.

Cardholders can raise a dispute for transactions – including those done over the phone – to their card issuer, where the retailer did not provide the product or service, deliver on its own terms, or the transaction went ahead without the cardholder’s consent. This can result in a chargeback where the merchant is charged a fee and the full amount that was disputed.

The merchant should therefore be careful to get consent for each card transaction done over the phone. To avoid chargebacks, you should consequently get enough details from the customer to back up the consent. This could be the card security code, billing address, customer name as it appears on the card, etc.

If a credit (not debit) card is used for a £100+ transaction, section 75 of the Consumer Credit Act 1974 gives the consumer the right to claim back the money for a telephone transaction they did not clearly consent to.

Note From the Editor.

The reason for this post today is that my daughter wanted to cancel her contract early with a mobile phone provider in the UK. She first spoke to someone who said they could not make the payment over the phone because they were working from home and that they would get the billing department to phone my daughter within the hour.

It was not long after my daughter received the call from the company and she could tell it was a call center because of the background noise. The operator then asked for my daughter’s card details over the phone without encryption and the worrying part was they asked for my daughter’s CVV number.

Now if this was me and I should have warned my daughter ahead of the call that if anyone asks for a CVV number refuse to give it and just insist they send a link to a secure payment method.

The amount was quite significant and now my daughter and I are worried that her details could have been stored for a later date. It does not take much effort to write the details down or screenshot a screen. One could even use a spy camera if mobile phones, pens, and notepads are prohibited.

I will be contacting the company for comment before publishing their name and my findings with Ofcom and the card payment companies who will all be making their inquiries.

**All Card issuers and banks should have a PPI & DSS Compliance Page on their websites giving consumers an opportunity to report companies to them, for them to investigate. Furthermore, the Banks and Credit Card issuers should also spread awareness to help counteract the UK £2 Billion credit card/debit card fraud problem. Merchants should only use telephone encryption software which should be made mandatory by law.
